Terms and Conditions

The legal rules and terms governing the use of the HomeDNA mobile apps, the web application at /app/, and this website.

Operator: HomeDNA (Tenforty LLC)•Lathrop, California, USA•Contact: info@tenforty.tax

1. Agreement

These terms are a contract between you and HomeDNA ("we", "us") for the HomeDNA mobile apps, the web app at /app/, and this website. By creating an account, signing in, or using HomeDNA, you agree to these terms and to the Privacy Policy.

If you do not agree, do not use the app. If you use HomeDNA for a company or for properties you manage for someone else, you confirm you have authority to do so and to store that information in the app.

2. The Service

HomeDNA helps you keep a private record of homes and rental properties: documents, inventory, repairs, maintenance reminders, vendors, expenses, and rental turnover notes.

In the current release, those records are stored on your device. We provide sign-in, in-app notices, and update checks. We plan to offer an optional cloud sync feature in future releases, allowing users to choose to sync records across devices with explicit opt-in consent.

Important Disclaimer on Professional Advice:

HomeDNA is a record-keeping tool. It is not a property manager, accountant, lawyer, insurer, or contractor. Records you enter, including costs, warranty dates, and deposit notes, are only as accurate as what you save. Check important dates and amounts against original documents before relying on them.

3. Accounts & Eligibility

You need an account to use the app. You can sign up with email and password, Google, or Apple.

You are responsible for the activity on your account and for keeping access to your email and devices. Tell us at info@tenforty.tax if you believe someone else is using your account.

You must be at least 13 years old. If you are under the age of majority where you live, you may use HomeDNA only with a parent or guardian who agrees to these terms.

4. Your Records & Ownership

You own the content you add to HomeDNA. We do not claim ownership of your properties, documents, photos, or notes.

Because those records stay on your device, you are responsible for keeping a copy. Deleting the app, clearing browser data, or losing the phone can delete them. A backup file is the way to keep a copy you control. If you protect a backup with a passphrase, store that passphrase somewhere safe. We cannot reset it or open the file for you.

When you share a vendor card or a backup through another app, that share is your choice, and the other app's terms apply.

5. Acceptable Use

Use HomeDNA for your own homes and for properties you are allowed to manage. Do not:

  • Break the law, or store content you do not have the right to keep.
  • Attempt to break, probe, or disrupt the sign-in service, the website, or another person's account.
  • Reverse engineer the app except where the law specifically allows it.
  • Use the app to send spam or to mislead someone about a vendor, a repair, or a property.

We may suspend or close an account that violates these terms. You can stop using HomeDNA at any time and delete your account.

6. Third-Party Services

Sign-in may be provided through Google or Apple. Hosting for accounts, announcements, and version checks is provided by Supabase. Your use of those services is also subject to their terms. App stores that distribute HomeDNA have their own terms, including Google Play and the Apple App Store. If those terms conflict with these on a point the store requires, the store's terms control for that point.

7. Disclaimers & Limitation of Liability

HomeDNA is provided "as is" and "as available." We work to keep sign-in and the app reliable, but we do not promise that the app will be uninterrupted, that reminders will always be delivered by the phone's operating system, or that a backup file will be recoverable if it is damaged, incomplete, or locked with a passphrase you no longer have.

Liability Cap:

To the extent the law allows, HomeDNA and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost records, or the cost of substitute services. Our total liability for a claim relating to the service is limited to the greater of the amount you paid us for HomeDNA in the 12 months before the claim, or 50 US dollars ($50.00 USD).

8. Governing Law & Jurisdiction

These terms are governed by the laws of the State of California, USA, excluding its conflict-of-law rules. Courts in San Joaquin County, California, or the federal courts located in California, are the venue for disputes, except that you may also bring a claim in your local small-claims court if it qualifies.
